Terms & Conditions
These terms are an agreement between you and Thymi (“Thymi”, “we”, “us”) for using the Thymi app and website. By creating an account or using Thymi, you agree to them. If you don’t agree, please don’t use Thymi. Questions: fzofficial429@gmail.com.
1. Who can use Thymi
You must be at least 16 years old, and old enough to agree to these terms where you live. You’re responsible for your account: keep your password private and tell us if you think someone else is using it.
2. What Thymi does
Thymi helps you log food and drink, estimate calories and nutrients, track water, workouts and weight, and see your progress. Features may change as we improve the app, and some features (such as coach chat or Apple Health sync) may be marked “coming soon” until they are available.
3. Health disclaimer
- Thymi is for general wellness and habit building. It is not a medical device and does not diagnose, treat, cure or prevent any condition.
- Calorie, nutrient, Plate Score, BMI, target and calories-burned figures are estimates. Results from photos and descriptions are produced with AI and food databases and can be wrong, so check anything important.
- Talk to a doctor or registered dietitian before changing how you eat if you are pregnant or breastfeeding, have or have had an eating disorder, have a medical condition, or take medication that affects appetite or weight, including GLP-1 medications.
- If you feel unwell, stop and seek medical help.
4. Free plan and Thymi Pro
- Free: Thymi is free to use with limits, including a daily number of AI logs and a limited history window. Current limits are shown in the app on the Plans screen.
- Thymi Pro is an auto-renewing subscription, offered monthly or yearly, that removes those limits. Prices are shown in the app before you buy and may vary by country.
- Billing: Pro is sold and billed by Apple (App Store) or Google (Google Play). Payment is charged to your store account when you confirm the purchase.
- Renewal: your subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Your store account is charged for renewal within 24 hours before the end of the current period.
- Free trial: if a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a trial is lost when you buy a subscription.
- Cancelling: manage or cancel in your device’s store settings (on iPhone: Settings → your name → Subscriptions). Deleting the app or your Thymi account does not cancel a subscription. After cancelling, Pro stays active until the end of the period you paid for, then your account returns to the free plan.
- Refunds are handled by Apple or Google under their policies; we can’t issue refunds for store purchases ourselves.
- Price changes: if the price of Pro changes, Apple or Google will tell you in advance and, where required, ask for your agreement.
5. Fair use
Please don’t misuse Thymi. That includes trying to access other people’s accounts or our systems without permission, interfering with the service, scraping or sending automated requests, reverse engineering the app except where the law allows it, or using Thymi for anything illegal. Plans include fair-use limits on AI logging to keep the service reliable. We may suspend or close accounts that break these rules.
6. Your content
What you log, including meal photos and descriptions, stays yours. You give us permission to store and process it, including sending it to our AI provider, only to run Thymi for you, as described in our Privacy Policy. Only upload photos you have the right to use.
7. Our app and third-party data
Thymi’s app, design, name and logo belong to us. We give you a personal, non-transferable, revocable licence to use the app for your own non-commercial purposes under these terms. Nutrition data comes partly from USDA FoodData Central (public domain) and Open Food Facts (available under the Open Database License). Third-party data can contain errors.
8. App Store terms
If you downloaded Thymi from Apple’s App Store, Apple’s Licensed Application End User License Agreement also applies. These terms are between you and Thymi, not Apple; Apple is not responsible for Thymi or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
9. Availability and changes
We work to keep Thymi available and your data safe, but we can’t promise the service will always be uninterrupted or error-free. We may change or discontinue features. If we discontinue Thymi entirely, we’ll give reasonable notice where we can so you can request a copy of your data.
10. Ending your account
You can stop using Thymi and delete your account at any time in Me → Delete account. We may suspend or end your access if you break these terms or if we have to for legal reasons. Remember to cancel any subscription in your store settings.
11. Disclaimers and liability
Thymi is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim warranties of any kind, including that nutrition estimates are accurate or that Thymi is fit for a particular purpose. To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for decisions you make based on Thymi’s estimates, and our total liability for any claim is limited to the amount you paid us for Thymi Pro in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded.
12. Changes to these terms
We may update these terms. We’ll change the date at the top, and if a change is significant we’ll let you know in the app before it takes effect. Continuing to use Thymi after the change means you accept the new terms.
